This Acceptable Use Policy ("AUP") governs the use of communication services provided by Zavu Labs Inc. ("Zavu", "we", "our", or "us").

By using the Services, you agree to comply with this policy. Violations may result in suspension or termination of access without notice.

Prohibited Uses

Customer may not use the Services for:

  • Spam or unsolicited messaging
  • Phishing, fraud, or scams
  • Deceptive or misleading content
  • Malware or malicious activity
  • Illegal goods or services
  • Circumvention of carrier or platform safeguards
  • Sub-reselling or third-party access without authorization
  • Identity misrepresentation or spoofing (misrepresenting sender identity through message body or phone number)

Prohibited Content Categories

The following content categories are strictly prohibited regardless of legality in your jurisdiction. Messages promoting, advertising, or linking to any of the following will result in immediate account suspension or termination:

  • Sexual, adult, or pornographic content, including escort services and adult entertainment
  • Firearms, ammunition, explosives, and fireworks
  • Alcohol, tobacco, vaping, and nicotine products
  • Illegal drugs, controlled substances, and drug paraphernalia
  • Cannabis and CBD products (regardless of local legality)
  • Gambling, sports betting, casinos, and lottery promotions
  • Cryptocurrency trading, token sales, NFTs, and related promotions
  • High-risk financial services: loans, loan forgiveness, credit repair, debt collection, or tax-related messaging
  • Investment opportunities, get-rich-quick schemes, or financial advisory promotions
  • Multilevel marketing (MLM) or pyramid schemes
  • Unsolicited real estate inquiries (e.g., "We Buy Houses" campaigns)
  • Abusive, harassing, threatening, or hate speech content
  • Content that promotes violence, self-harm, or dangerous activities

This list is not exhaustive. Zavu reserves the right to reject or block any content that, in its sole discretion, poses a risk to the platform, its users, or its carrier and channel partners.

Messaging Compliance

All messages sent through Zavu must comply with:

  • Applicable laws and regulations (including TCPA, GDPR, CAN-SPAM, CASL)
  • Carrier and platform policies (including WhatsApp Business Messaging Policies and CTIA Messaging Principles)
  • A2P (Application-to-Person) messaging best practices
  • Proper consent and opt-in requirements

Consent and Opt-In Requirements

All recipients must have explicitly opted in to receive messages from you. The following practices are prohibited and constitute invalid consent:

  • Purchasing or using third-party contact lists
  • Collecting phone numbers or emails for one purpose and messaging for another
  • Converting transactional opt-ins into marketing campaigns
  • Scraping phone numbers or emails from websites or public sources

Upon receiving an opt-out request (STOP, UNSUBSCRIBE, or similar keywords), you must remove the recipient from your messaging list within 24 hours.

Message Frequency Limits

You may not send more than 10 messages to a single recipient in any 24-hour period, unless an active two-way conversation exists or the recipient has explicitly consented to receive higher-frequency messages. Excessive messaging may result in throttling or account suspension.

Content Requirements

All content sent through the Services must:

  • Be accurate and not misleading
  • Clearly identify the sender
  • Include opt-out instructions where required
  • Respect recipient preferences and consent
  • Not contain harmful, offensive, or illegal material

WhatsApp-Specific Requirements

When using WhatsApp as a channel, you must also:

  • Obtain explicit opt-in consent before messaging
  • Respect the 24-hour customer service window
  • Use only approved templates for initiating conversations
  • Maintain records of consent for audit purposes
  • Honor opt-out requests promptly

Rate Limits and Fair Use

Customers must respect rate limits and use the Services in a manner that does not negatively impact other users or the platform's infrastructure. Excessive usage or abuse of the Services may result in throttling or suspension.

Financial Fraud and Payment Abuse

The following activities are strictly prohibited and will result in immediate account termination and cooperation with law enforcement:

  • Using stolen, fraudulent, or unauthorized payment methods
  • Creating accounts using false or stolen identity information
  • Initiating chargebacks for legitimate charges (chargeback fraud)
  • Exploiting billing systems or promotional offers
  • Using the Services to facilitate financial fraud against third parties

Zavu monitors for suspicious activity and reserves the right to require additional identity verification at any time. Accounts flagged for potential fraud may be suspended pending verification.

Enforcement

Zavu reserves the right to:

  • Monitor usage for compliance with this policy
  • Suspend or terminate accounts that violate this policy
  • Block specific phone numbers, templates, or content
  • Report violations to relevant authorities
  • Cooperate with law enforcement investigations
